Scope and contracting party
These terms apply to all contracts that you conclude via the galleries on this website with [Not provided], [Not provided], [Not provided] ("we"). The website is technically provided via Passepartout; your contracting party is exclusively us. Deviating terms do not apply.
Conclusion of the contract
The presentation of images, packages, photo products does not constitute a binding offer but an invitation to submit an offer.
Ordering in the gallery: You select individual images, packages, all images of the gallery or photo products and buy them directly or via the shopping cart. In the shopping cart you can see all items, the shipping costs and the total price, and you can change your selection at any time. "Checkout" takes you to the payment page of our payment service provider Stripe, where you enter your details and review them once more. By clicking the button that places the order with an obligation to pay (e.g. "Pay"), you submit a binding offer. The contract is concluded as soon as your payment has been confirmed; you will receive a confirmation of this by email and on the order page.
Until you submit your order, you can identify and correct input errors via the shopping cart, your browser's back function and the fields on the payment page.
Contract languages and storage of the contract text
The contract languages are German, English, French, Spanish, Italian and Dutch; these terms and the cancellation policy are available in each of these languages, and the language in which you place your order is authoritative. We store the contract text (order, prices, these terms and the cancellation policy in the version valid at the time of the order) and send you the order data together with these terms by email. You can access your order via the link in the confirmation for as long as the gallery is online. Please keep the confirmation email with the attached terms.
Prices, payment and invoice
All prices are final prices and include statutory VAT. If you live in another EU member state, we determine the VAT in accordance with the statutory rules (where applicable at the rate of your country); this does not change the final price. Businesses with a valid VAT identification number from another EU member state pay the net price; the tax is then owed by the recipient of the supply (reverse charge). No EU VAT is charged to customers outside the European Union; import duties of your country are borne by the recipient.
You can see the shipping costs for photo products in the shopping cart before ordering. Payment is made via Stripe (depending on what the payment page offers, e.g. credit card, Apple Pay, Google Pay or SEPA Direct Debit) and is due upon conclusion of the contract. For each order you automatically receive an invoice and, in the case of refunds, a credit note in electronic form; you agree to this.
Image files (digital content)
Once payment has been received, we make the purchased files available for download immediately (link on the order page and in the email). The rights of use are governed by the licence terms of the selected licence; the copyright remains with us. Please save the files promptly, as galleries are only online for a limited time.
Purchased files are excluded from exchange. Your right of withdrawal expires as soon as we begin supplying the files if you have previously given your express consent and acknowledged that you thereby lose your right of withdrawal, and we have confirmed the contract to you on a durable medium (see cancellation policy). Your statutory rights in the event of defects in the digital content (§§ 327 et seq. BGB) remain unaffected.
Photo products
Photo products are made individually according to your selection – where applicable by a photo lab – and shipped to the delivery address provided. We deliver to the countries offered on the payment page. The delivery time is up to 10 working days from receipt of payment.
As goods made to the consumer's specifications, photo products are excluded from the right of withdrawal and from exchange. Please check the delivery upon receipt and report any transport damage as soon as possible; this does not affect your statutory rights. Depending on the device, colours on screen may look different from the print.
Warranty and liability
The statutory rights in respect of defects apply. We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Produkthaftungsgesetz (German Product Liability Act) and to the extent of any guarantee given. In the event of a slightly negligent breach of an essential contractual obligation – an obligation whose fulfilment is a prerequisite for the proper performance of the contract and on whose compliance you may rely – our liability is limited to the foreseeable damage typical for the contract; otherwise we are not liable for slight negligence.
Right of withdrawal
As a consumer, you have a right of withdrawal in accordance with the cancellation policy. You can also declare your withdrawal using the Withdraw from contract function.
Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
Applicable law
The law of the state in which we have our registered office (Germany) applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another state, you retain the protection afforded by the mandatory provisions of the law of that state.
